Why it’s set up this way: ACIC rules mean we can’t hand a check’s outcome to a labour hire or recruitment business directly. Routing candidates to us as their own provider — who then choose to share their own certificate with you — is exactly how that works in practice, and it’s why so many labour hire businesses use us without ever needing to be set up as an accredited Customer. Licensing obligations
Labour Hire Licensing — What You Need to Know in 2026
Labour hire licensing now applies in four Australian jurisdictions — VIC, QLD, SA, and ACT. All require directors and responsible persons to hold a current National Police Certificate, and all impose significant penalties on both providers and hosts for non-compliance.
South Australia expanded its scheme in December 2025 to cover all labour hire providers, not just high-risk sectors. If you operate across state borders, you need to treat each jurisdiction’s requirements separately.
Victoria
Up to $581,568 (corp)
Labour Hire Authority. Licences up to 3 years. Hosts prohibited from using unlicensed providers. Police check required for all directors and responsible persons.
Queensland
Up to $2,430,000 (corp)
Annual licence renewal. Highest penalties in Australia. Executive officers must be fit and proper persons with current police certificates.
South Australia
Expanded Dec 2025
All providers now covered — not just high-risk sectors. Six-month transition period in effect. Aligns with VIC and QLD requirements.
ACT
Penalties apply
Labour Hire Licensing Act 2020. Administered by Access Canberra. Same fit and proper person requirements as other jurisdictions.
The legal bit
Where the ACIC Draws the Line
From 1 January 2025, ACIC rules stop Accredited Bodies like Worker Checks from disclosing a National Police Certificate’s outcome — clear, DCO, or anything in between — to a labour hire, recruitment or staffing business, even with the candidate’s consent. The result belongs to the candidate.
That doesn’t stop you using us — it just shapes how. Because candidates apply as their own customer through your link, we’re never disclosing anything to you: the candidate is simply choosing, of their own accord, to forward on a document that’s theirs. That’s the model this page is built around, and it’s fully within the rules.
What we can’t do: we can’t confirm a specific candidate’s result to you directly, and we can’t act as a pass-through where your business is the one submitting or receiving checks on candidates’ behalf. Is it legal for us to just send candidates a link to your site?
Yes. Because the candidate applies directly with us as their own customer, and it’s their choice whether to share their own certificate with you afterwards, there’s no restricted disclosure happening — we’re never handing you a result. This is the arrangement most of our labour hire and recruitment partners already use, including high-volume ones.
Can you tell us directly whether a candidate’s check came back clear?
No — ACIC rules stop us disclosing a check’s outcome to a labour hire, recruitment or staffing business, even with the candidate’s consent. The certificate sits in the candidate’s own portal and it’s up to them to share it with you, which is exactly what this arrangement is built around.
Do we need to set up an account or become an ACIC-approved Customer to use this?
No. Sharing our link with candidates doesn’t require any accreditation, contract, or account setup on your end. That’s only needed if you want checks run for your own directly-employed staff through BusinessHub instead — different model, and one we’re happy to talk through if it fits you better.
How fast is it, realistically?
80% of checks are returned within 1–3 minutes of a candidate submitting their application. It’s mobile-first, so a candidate called up same-day can complete it before they arrive on site.
Will this meet our labour hire licensing obligations?
Our National Police Check is ACIC-accredited and accepted Australia-wide, including for VIC, QLD, SA and ACT labour hire licensing purposes. If the obligation is for your own directors or responsible persons rather than candidates, the same check applies — get in touch if you’d like to talk through the right setup.
Can the same certificate be used for more than one placement?
Yes. The certificate is the candidate’s own document, valid for the period it was issued, and they can share it with as many host businesses as they like during that time — no re-applying required.
