Victoria-specific note: since the Spent Convictions Act 2021 (VIC) commenced 1 December 2021, spent convictions and pending charges generally won’t appear on standard Victorian employment checks, unless an exemption applies (e.g. working with children, aged care, NDIS, or AHPRA-regulated roles).

Common questions

Police Check VIC — FAQ

Who can request a Police Check VIC?

Anyone seeking employment, volunteer positions, or visa applications can apply. Employers may also request checks for employees, and educational institutions or licensing bodies often require one for students or professionals in certain fields.

Can I run a check on someone else?

No. A police check can only be conducted with the informed consent of the person it’s for. Applicants must be at least 16 years old.

Do pending charges show up on a VIC police check?

No — Victoria is the exception. Since changes to the Spent Convictions Act commenced in December 2021, pending charges generally do not appear on standard Victorian employment checks, unlike most other states and territories.

How long does it stay valid?

A police check has no fixed expiry — it’s a point-in-time result. The organisation requesting it decides how recent the certificate needs to be.
