What appears on a Victorian police check?
On a standard employment Police Check VIC, disclosure is governed by Victoria’s Spent Convictions Act 2021. Here is what generally does and doesn’t appear.
- Court convictions that are not spent

- A finding of not guilty by reason of mental impairment
- Minor infringements never taken to court (except drink/drug driving and excessive speed)
When do convictions become “spent” in Victoria?
Victoria’s Spent Convictions Act 2021 commenced on 1 December 2021. Once a conviction is spent, it no longer forms part of your criminal record and won’t appear on a standard employment police check.
- Adults: most convictions are spent automatically after a 10-year conviction (crime-free) period.
- Children and young people: the period is 5 साल.
- Some convictions are spent immediately — for example, where the person was under 15 at the time of the offence.
- गंभीर दोषसिद्धि — serious violence offences, or any offence with a sentence of more than 30 months imprisonment or detention — can only be spent by application to the Magistrates’ Court, available since 1 July 2022.

What shows up on a Victorian police check?
A standard employment check generally shows disclosable court outcomes that are not spent — convictions, certain findings of guilt, and court orders — from anywhere in Australia. It generally does not show spent convictions, pending charges, ongoing investigations, or minor infringements that never went to court, unless an exemption applies.
Do pending charges show up on a police check in Victoria?
No. On a standard Victorian employment check, pending charges — matters a court has not yet decided — generally do not appear. This has been the position since the Spent Convictions Act 2021 commenced on 1 December 2021. Pending charges can still be disclosed for exempt purposes such as a Working with Children Check, NDIS worker screening, or AHPRA-registered roles.
