What appears on a NSW police check?
Sa isang karaniwang trabaho Police Check NSW, disclosure is governed by the Criminal Records Act 1991 (NSW). Here is what generally does and doesn’t appear.

- Mga kinalabasan ng pagkakasangkot sa krimen at ilang mga kautusan ng hukuman
- Nakabinbing singil — matters before a court that aren’t yet finalised
- Spent convictions (under the Criminal Records Act 1991)
- Convictions older than the crime-free period that meet the spent criteria

- Minor infringements that were never dealt with by a court
When do convictions become “spent” in NSW?
New South Wales runs a spent convictions scheme under the Batas sa mga Rekord ng Kriminal 1991 (NSW). Once a conviction is spent it is generally non-disclosable — it won’t appear on a standard police check and you don’t have to disclose it. Spending is automatic; there’s no application.
- Para sa mga matatanda: a conviction is spent after a 10-taon crime-free period from the date of conviction.
- Children (dealt with in the Children’s Court): the crime-free period is 3 years.
- Some convictions are spent immediately — for example, where a court finds a person guilty but records no conviction.
- Reoffending during the crime-free period (an offence punishable by imprisonment) restarts the clock.
Convictions that can never be spent in NSW
Under the Act, some convictions are permanently excluded and will always appear:
- Any conviction where a prison sentence of more than 6 months was imposed.
- All convictions for sexual offences.
- Convictions against a company or body corporate, and any convictions prescribed by the regulations.
The scheme also applies to interstate and Commonwealth convictions that correspond to NSW offences. Unlawfully disclosing someone’s spent conviction is an offence under the Act.
