What appears on a NSW police check?

NSW differs from Victoria on pending charges. On a standard NSW check, pending charges do appear, because they are disclosable court outcomes. In Victoria, pending charges generally don’t appear on a standard employment check.

When do convictions become “spent” in NSW?

  • Children (dealt with in the Children’s Court): the crime-free period is 3 years.
  • Some convictions are spent immediately — for example, where a court finds a person guilty but records no conviction.

Convictions that can never be spent in NSW

Under the Act, some convictions are permanently excluded and will always appear:
