On a standard employment Police Clearance SA, disclosure of older South Australian convictions is governed by the Spent Convictions Act 2009 (SA). Here is what generally does and doesn’t appear.

When do convictions become “spent” in South Australia?

South Australia’s spent convictions scheme sits under the Loi de 2009 sur les condamnations non exécutées (SA). Under the Act it is an offence to release a spent conviction on a police check, and a spent conviction can’t be taken into account for most purposes. Eligible convictions become spent automatically once a qualification period passes without reoffending.

  • Adults: a 10-year qualification period from the date of the conviction.
  • Juveniles: a 5-year qualification period (unless dealt with as an adult).
  • Eligibility threshold: only convictions where the sentence of imprisonment was 12 months or less (adult) or 24 months or less (juvenile) can become spent this way. Convictions above that are excluded.
  • An outcome of “no conviction recorded” is treated as spent immediately.
  • Reoffending during the qualification period — in SA or elsewhere — restarts it.

Some serious matters follow a different path: an eligible sex offence can only be made spent by applying to a magistrate, and cannot be re-applied for within two years of a refusal.

Exclusions — some roles see more. Even a spent SA conviction can still be disclosed for certain prescribed purposes — including working with children, working with vulnerable people, and other roles set out in the legislation.
