When do convictions become “spent” in Queensland?

Queensland runs a spent convictions scheme under the Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld). A conviction becomes spent automatically once the rehabilitation period passes without reoffending — there’s no application, form or court hearing; it happens by operation of law.

  • 10 年 for a conviction on indictment in the Supreme or District Court where the person was an adult.
  • 5 年 for all other convictions — Magistrates Court or summary offences, and any conviction where the person was a juvenile.
  • The period runs from the date of conviction, and a further offence during it 重启 the clock from the later conviction.
  • Convictions with a sentence of more than 30 months imprisonment — whether or not suspended — are 被排除在外 and can never be spent.
A feature unique to Queensland: once a conviction is spent under the 1986 Act, you may lawfully state — even under oath — that you were not convicted of that offence, unless an exemption applies to the purpose of the check.

Exemptions — some roles see more

For certain purposes, spent convictions can still be disclosed and you may be required to reveal them. These include Blue Card (working with children in Queensland), police and court roles, and other positions prescribed under section 9A of the Act.

Yes. A Police Check QLD is a Nationally Coordinated Criminal History Check (NCCHC). It draws on the national police database and is recognised in every Australian state and territory, so a check started from the “Queensland” page is valid nationwide.

What shows up on a Queensland police check?

A standard employment check shows disclosable court outcomes from anywhere in Australia — recorded convictions that are not spent, findings of guilt, certain court orders, and pending charges. Spent convictions generally do not appear unless the check is for an exempt purpose such as working with children.

When does a conviction become spent in Queensland?
