- Convictions that are not spent
- 罪名成立的证据和某些法院命令
- Pending charges — matters before a court that aren’t yet finalised
- 法院判决的驾驶违法行为(例如酒后驾车、毒品驾驶、危险驾驶)

- Convictions that have been pardoned or quashed
When do convictions become “spent” in South Australia?
South Australia’s spent convictions scheme sits under the 2009 年《已定罪法》(南非). Under the Act it is an offence to release a spent conviction on a police check, and a spent conviction can’t be taken into account for most purposes. Eligible convictions become spent automatically once a qualification period passes without reoffending.
- 成年人: a 10-年 qualification period from the date of the conviction.
- Juveniles: a 5-year qualification period (unless dealt with as an adult).
- Eligibility threshold: only convictions where the sentence of imprisonment was 12 months or less (adult) or 24 months or less (juvenile) can become spent this way. Convictions above that are excluded.
- An outcome of “no conviction recorded” is treated as spent immediately.
- Reoffending during the qualification period — in SA or elsewhere — restarts it.
Some serious matters follow a different path: an eligible sex offence can only be made spent by applying to a magistrate, and cannot be re-applied for within two years of a refusal.

Police Clearance SA — FAQ
Is an SA police clearance the same as a national police check?
Yes. In South Australia a “police clearance” or “national police certificate” is a Nationally Coordinated Criminal History Check (NCCHC). It draws on the national police database and is recognised in every Australian state and territory, so a clearance obtained through Worker Checks is valid nationwide.
What shows up on an SA police clearance?
A standard employment clearance shows disclosable court outcomes from anywhere in Australia — convictions that are not spent, findings of guilt, certain court orders, and pending charges. Spent convictions under the Spent Convictions Act 2009 generally don’t appear unless the check is for an exempt purpose such as working with children.
When does a conviction become spent in South Australia?
Under the Spent Convictions Act 2009 (SA), an eligible conviction is spent automatically after a qualification period of 10 years for adults or 5 years for juveniles, with no reoffending. Only convictions with a sentence of imprisonment of 12 months or less (adult) or 24 months or less (juvenile) are eligible. An outcome of “no conviction recorded” is spent immediately.
Do pending charges show up on an SA police clearance?
Generally yes. In South Australia, as in most states, pending charges and unfinalised matters before a court can appear on a standard check as disclosable court outcomes. Victoria is the main exception, where pending charges usually don’t appear on a standard employment check.
What happens if I’ve had a legal name change?
Your check is run against your identity, not a single name, so convictions or spent convictions tied to a previous legal name are still handled correctly — whether or not you’ve updated all of your documents. Enter your current and previous names when asked so the search is complete.
How much does an SA police clearance cost?
An SA employment police clearance is $52.00 and a volunteer clearance is $21.00, 该服务包括 Worker Checks 增值税(GST)。在结账时无需支付任何手续费或交易费用,因此显示的价格就是您实际支付的价格。.
How long does an SA police clearance take?
Around 80% of clearances are returned within 1–3 minutes. The remaining applications are referred for manual review by police agencies, which can take up to around 15 business days — no provider can speed up a manual review.
How long is my clearance available after I receive it?
Your result is available in your Worker Checks portal for 3 months, after which it is removed under Commonwealth requirements — so download and save your certificate within that window. A police clearance has no fixed expiry, but most organisations won’t accept one older than 3 months.
Can I run a police clearance on someone else?
No. A police clearance can only be conducted with the informed consent of the person it is for, and applicants must be at least 16 years old.
