What appears on a Queensland police check?

On a standard employment Police Check QLD, disclosure is governed by the Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld). Here is what generally does and doesn’t appear.

When do convictions become “spent” in Queensland?

Queensland runs a spent convictions scheme under the Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld). A conviction becomes spent automatically once the rehabilitation period passes without reoffending — there’s no application, form or court hearing; it happens by operation of law.

  • 10 năm for a conviction on indictment in the Supreme or District Court where the person was an adult.
  • 5 năm for all other convictions — Magistrates Court or summary offences, and any conviction where the person was a juvenile.
  • The period runs from the date of conviction, and a further offence during it restarts the clock from the later conviction.
  • Convictions with a sentence of more than 30 months imprisonment — whether or not suspended — are bị loại trừ and can never be spent.
A feature unique to Queensland: once a conviction is spent under the 1986 Act, you may lawfully state — even under oath — that you were not convicted of that offence, unless an exemption applies to the purpose of the check.

Exemptions — some roles see more

For certain purposes, spent convictions can still be disclosed and you may be required to reveal them. These include Blue Card (working with children in Queensland), police and court roles, and other positions prescribed under section 9A of the Act.

Convicted in Brisbane in 2018, now living in Melbourne and applying for a job? Yes. A police check is national, so a conviction recorded in Queensland appears no matter which state you apply from. Generally, the spent-conviction rules of the state where you were convicted determine whether it is still disclosed.
