Once a conviction is spent it is generally non-disclosable \u2014 it won\u2019t appear on a standard police check and you don\u2019t have to disclose it. Spending is automatic; there\u2019s no application.<\/p>\n      <ul>\n        <li><strong>Adults:<\/strong> a conviction is spent after a <strong>10-year<\/strong> crime-free period from the date of conviction.<\/li>\n        <li><strong>Children (dealt with in the Children\u2019s Court):<\/strong> the crime-free period is <strong>3 years<\/strong>.<\/li>\n        <li><strong>Some convictions are spent immediately<\/strong> \u2014 for example, where a court finds a person guilty but records no conviction.<\/li>\n        <li>Reoffending during the crime-free period (an offence punishable by imprisonment) <strong>restarts<\/strong> the clock.<\/li>\n      <\/ul>\n      <h3>Convictions that can never be spent in NSW<\/h3>\n      <p>Under the Act, some convictions are permanently excluded and will <strong>always<\/strong> appear:<\/p>\n      <ul>\n        <li>Any conviction where a prison sentence of <strong>more than 6 months<\/strong> was imposed.<\/li>\n        <li><strong>All convictions for sexual offences.<\/strong><\/li>\n        <li>Convictions against a company or body corporate, and any convictions prescribed by the regulations.<\/li>\n      <\/ul>\n      <p>The scheme also applies to interstate and Commonwealth convictions that correspond to NSW offences.
