A conviction becomes spent automatically once the <strong>rehabilitation period<\/strong> passes without reoffending \u2014 there\u2019s no application, form or court hearing; it happens by operation of law.<\/p>\n      <ul>\n        <li><strong>10 years<\/strong> for a conviction on indictment in the <strong>Supreme or District Court<\/strong> where the person was an adult.<\/li>\n        <li><strong>5 years<\/strong> for all other convictions \u2014 <strong>Magistrates Court<\/strong> or summary offences, and any conviction where the person was a <strong>juvenile<\/strong>.<\/li>\n        <li>The period runs from the date of conviction, and a further offence during it <strong>restarts<\/strong> the clock from the later conviction.<\/li>\n        <li>Convictions with a sentence of <strong>more than 30 months<\/strong> imprisonment \u2014 whether or not suspended \u2014 are <strong>excluded<\/strong> and can never be spent.<\/li>\n      <\/ul>\n      <div class=\"callout\">\n        <strong>A feature unique to Queensland:<\/strong> once a conviction is spent under the 1986 Act, you may lawfully state \u2014 even under oath \u2014 that you were not convicted of that offence, unless an exemption applies to the purpose of the check.\n      <\/div>\n      <h3>Exemptions \u2014 some roles see more<\/h3>\n      <p>For certain purposes, spent convictions can still be disclosed and you may be required to reveal them.
